Terms of Service

These Terms of Service (“Terms”) are a legal agreement between you and iTaxCA (“we”, “us”, “our”) governing your use of itaxca.com and related services (the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and capable of entering into a binding contract under Indian law. If you register on behalf of a firm (e.g. a Chartered Accountancy practice), you confirm you are authorised to bind that firm.
2. What the Service does
iTaxCA is a technology platform that reads the documents you upload, applies the relevant year’s income-tax rules, prepares a draft income-tax return, and — if you choose — lets you appoint a Chartered Accountant to review and file it. iTaxCA is not a Chartered Accountancy firm and does not itself provide chartered-accountancy, legal or investment advice. Where you engage a CA through the platform, that CA is independently responsible for their professional judgement, review and filing.
3. Not a substitute for professional judgement; your responsibility
- Figures are computed from the documents and information you provide. You are responsible for providing accurate, complete records.
- You (and, where engaged, your CA) are responsible for reviewing the return before it is filed and for the correctness of what is ultimately filed with the Income Tax Department.
- The Service assists with preparation; it does not guarantee any particular tax outcome, refund, or that a return will be accepted or free of scrutiny.
4. Your account & conduct
- Keep your login credentials confidential; you are responsible for activity under your account.
- Provide truthful information and use the Service only for lawful purposes and your own (or your client's) tax affairs.
- Do not attempt to disrupt, reverse-engineer, or gain unauthorised access to the Service or other users' data.
5. Chartered Accountants (additional terms)
If you register as a CA / firm: you confirm your ICAI membership and Certificate of Practice are valid and current; your firm is subject to manual verification and may be suspended or removed if details cannot be verified or are misused; you will handle taxpayer data only for the engagement, in line with your professional obligations and our Privacy Policy; and access to a taxpayer’s data lasts only while that taxpayer’s engagement with you is active.
6. Fees
The Service is currently offered in beta, free of charge. We will give you clear notice before introducing any fees, and you may stop using paid features rather than pay.
7. Intellectual property & your data
We own the Service, its software and content. You retain ownership of the data and documents you upload; you grant us a limited licence to process them solely to provide the Service, as described in the Privacy Policy.
8. Beta & disclaimers
The Service is provided on an “as is” and “as available” basis during beta. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy, and uninterrupted availability. Automated document reading and computations may contain errors — always review before filing.
9. Limitation of liability
To the maximum extent permitted by law, iTaxCA will not be liable for any indirect, incidental, or consequential loss, or for loss of profits, data, or goodwill. Our total liability arising out of or relating to the Service is limited to the amount you paid us (if any) in the 12 months before the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
10. Indemnity
You agree to indemnify us against claims arising from your misuse of the Service, your breach of these Terms, or the inaccuracy of information you provide.
11. Suspension & termination
You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. On termination, your data is handled as described in the Privacy Policy.
12. Governing law & jurisdiction
These Terms are governed by the laws of India. Subject to applicable law, the courts at New Delhi shall have exclusive jurisdiction over any dispute arising from these Terms or the Service.
13. Changes
We may update these Terms from time to time. Where changes are material, we will notify you and, where required, ask you to accept the updated Terms. The version and effective date at the top show the current Terms.
